Terms of Service

Welcome to Bongo Software. These Terms of Service (“Terms”) govern your access to and use of our school management software system, including the mobile application **B-Academy** and our web dashboard located at **academy.bongosoftware.com** (“Platform”).

Please read these Terms carefully before using the Platform. By creating an account, logging in, or using any part of our services, you (representing yourself, a school institution, a teacher, a student, or a parent) agree to be bound by these Terms. If you do not agree with any part of these Terms, you are prohibited from using our services.

1. Definitions & Agreement

• “Bongo Software,” “We,” “Our,” or “Us” refers to the parent software company operating in Bangladesh.
• “Platform” refers to the Bongo School / B-Academy mobile app, admin portal, API services, and associated backend databases.
• “Customer” or “School” refers to the educational institution that purchases a subscription to use the Platform.
• “User” refers to any individual accessing the Platform, including School Administrators, Teachers, Staff, Students, and Parents.

2. Account Registration & Security

To access the features of B-Academy, you must be registered as part of an authorized educational institution.

• Accuracy of Information: School administrators and users must provide true, accurate, and complete registration details, including official phone numbers and email addresses.
• Account Confidentiality: Users are solely responsible for maintaining the confidentiality of their login credentials (phone numbers, OTPs, and passwords). Any action performed under your account is your sole responsibility.
• Unauthorized Use: You must immediately notify Bongo Software support if you detect or suspect any unauthorized login or security breach in your portal.

3. Permitted Use & Restrictions

Bongo Software grants you a limited, non-exclusive, non-transferable, and revocable license to access the Platform solely for school administration, educational operations, and communication purposes.

You agree NOT to:

• Decompile, reverse engineer, disassemble, or attempt to extract the source code of the B-Academy mobile application or backend services.
• Use the Platform for any illegal, fraudulent, or unauthorized administrative actions.
• Bypass, disable, or tamper with the API security protocols, rate limiters, or authentication layers of the server.
• Use automated scrapers, bots, or data mining tools to extract institutional, student, or teacher information.
• Upload or transmit any malware, viruses, or disruptive scripts to the server.

4. Subscriptions, Fees & Payment Processing

Institutions utilizing B-Academy agree to pay the subscription fees specified at the time of onboarding.

• Billing Cycle: Subscriptions are billed on a recurring monthly or annual basis. Unpaid balances may result in temporary suspension of Platform access for all school users.
• Payment Gateways: School fee collections, online student payments, and subscription fees may be processed securely via integrated localized gateways (such as SSLCommerz and bKash). Bongo Software is not liable for transaction failures caused by banking networks or gateway downtimes.
• Refund Policy: Subscription payments made to Bongo Software are non-refundable, except as explicitly agreed in writing in individual institutional service-level agreements (SLAs).

5. User-Generated Content & Student Data

Our Platform enables schools to upload student photos, grades, routines, library records, and fee details.

• Ownership: The school retains full ownership of all data uploaded to the Platform. Bongo Software acts solely as a data processor.
• Data Encryption & Safety: We implement premium security standards to protect student and institutional data. All data is encrypted in transit using industry-standard SSL/TLS protocols.
• Compliance: The school institution guarantees that it has obtained all necessary parental or guardian consents before uploading minor student records or photos to the digital ID card generator or databases.

6. Intellectual Property Rights

All intellectual property rights, trademarks, patents, branding designs, logo representations, page layouts, visual design systems, and software source code within the B-Academy Platform are the exclusive property of Bongo Software.

You may not copy, adapt, modify, or distribute our design components, logos, or codebase without prior explicit written permission from the executive management of Bongo Software.

7. System Availability & Service Disclaimer

• Uptime Commitment: We strive to maintain 99.9% uptime for the Bongo School backend servers. However, occasional system maintenance, server upgrades, or unexpected host issues on cloud platforms (e.g., DigitalOcean) may cause temporary service interruptions.
• No Warranties: The Platform is provided on an “AS IS” and “AS AVAILABLE” basis. Bongo Software makes no guarantees that the software will be completely error-free or uninterrupted.

8. Limitation of Liability

In no event shall Bongo Software, nor its directors, software developers, partners, or affiliates, be held liable for any direct, indirect, incidental, special, consequential, or punitive damages. This includes, without limitation, loss of business profits, data corruptions, network lags, or administrative discrepancies within schools arising from the use of or inability to use our services.

9. Termination of Service

We reserve the right to suspend or terminate access to the Platform for any school or user who violates these Terms, engages in suspicious security breaches, or defaults on subscription payments. Upon termination, the school may request a backup export of its student and academic records within 30 calendar days.

10. Governing Law

These Terms of Service and any associated legal agreements are governed by, and construed in accordance with, the laws of the People's Republic of Bangladesh, without regard to conflict of law principles. Any legal disputes shall be settled exclusively in the competent courts located in Dhaka, Bangladesh.

11. Changes to These Terms

We may update our Terms of Service from time to time. We will notify you of any material changes by posting the updated Terms on this page and updating the “Last Updated” date at the top. Your continued use of B-Academy after updates constitute acceptance of the modified Terms.
